White House Orders Don McGahn Not To Comply With Congressional Subpoena

The White House is instructing former White House Counsel Don McGahn not to comply with a subpoena from the Democrat-controlled House Judiciary Committee. The committee is investigating potential obstruction of justice by President Donald Trump and demanded that McGahn testify and turn over documents related to Special Counsel Robert Mueller's investigation.

In a letter to Chairman Jerry Nadler, White House Counsel Pat Cipollone wrote that the "records remain legally protected" and cannot be released, citing executive privilege.

"The White House records remain legally protected from disclosure under longstanding constitutional principles because they implicate significant executive branch confidentiality interests and executive privilege," Cipollone wrote.

McGahn's attorney also sent a letter to Nadler stating that his client will not provide the documents until the committee and the White House can reach an agreement.

The decision to refuse to comply with a subpoena is the latest in an ongoing battle between Congress and the White House over the disclosure of documents. On Monday (May 6), Treasury Secretary Steven Mnuchin denied a request from House Democrats for access to six years of Trump's tax returns.
